By accessing or using the Nex-Gen BI platform operated by Xylo4AI ("we", "our", or "us") at analytics.xylo4ai.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Nex-Gen BI is an AI-powered data analytics platform that allows users to upload data files (CSV, Excel), ask natural language questions, and receive automated insights, charts, and reports. The service uses artificial intelligence to generate SQL queries and analytical summaries.

3. Account Registration

• You must sign in using a valid Google account to access the platform.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Upload data that contains malware, viruses, or harmful code.
• Upload data that violates any applicable law or regulation.
• Attempt to gain unauthorized access to our systems or other users' data.
• Use the service to process data that you do not have the right to analyze.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.
• Use the service in any way that could damage, disable, or impair the platform.

5. Data Ownership

You retain full ownership of all data you upload to the platform. We do not claim any ownership rights over your data. By uploading data, you grant us a limited, non-exclusive license to process and analyze your data solely for the purpose of providing the analytics service to you.

6. AI-Generated Content

The insights, charts, SQL queries, and textual analysis generated by our AI are provided "as is" for informational purposes only. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You should independently verify any critical findings before making business decisions based on AI-generated analysis.

7. Service Availability

We strive to maintain high availability of the platform, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

8. Pricing & Payments

Certain features of the platform may require a paid subscription. Pricing details are available on our pricing page. We reserve the right to modify pricing with 30 days' notice. Refunds are handled on a case-by-case basis.

9. Limitation of Liability

To the maximum extent permitted by law, Xylo4AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.

10. Indemnification

You agree to indemnify and hold harmless Xylo4AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service or violation of these terms.

11. Termination

We may suspend or terminate your access to the service at any time for violation of these terms or for any other reason at our sole discretion. You may also terminate your account at any time by contacting our support team. Upon termination, your right to use the service ceases immediately, and we may delete your data within 30 days.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective when posted on this page. Your continued use of the service after changes constitutes acceptance of the updated terms.
